Terms & Conditions

By registering for a Swim4Seas experience, you agree to the terms below. Please read them carefully before paying your deposit. Your booking is made with LiveThrive.ai ("we", "us", "our"). If you're booking on behalf of a group, the person named as the lead booker is responsible for making sure everyone in the group has read and accepted these terms.

These terms apply to bookings made from [date].

1. Booking and Payment

1.1 Confirming your booking. Your place is confirmed once we have received your deposit and sent you a written booking confirmation. Anything before that (a held spot, a verbal "yes") is not a confirmed booking. If you don't receive a confirmation within 14 days of paying, please contact us.

1.2 Check your details. Please review your confirmation as soon as you receive it and let us know within 10 days if anything is wrong. Corrections requested after that may incur a cost.

1.3 Pricing. The Swim4Seas experience runs for 8 days with the inclusions listed on the trip page. Prices are in US Dollars (USD) and based on a minimum of 30 participants:

  • Per participant (shared room)         $5,951 USD*

  • Single supplement (private room)   $1,734 USD

  • Deposit (payable on registration)    $600 USD

*The per-participant price is subject to final participant numbers. If the group does not reach the minimum of 30, we may adjust the price or the arrangements and will let you know before you commit.

1.4 Payment schedule.

  • A non-refundable deposit of $600 USD is due at registration to secure your place.

  • The final balance is due 60 days before departure. If the balance isn't paid on time, we may treat the booking as cancelled and the deposit will be lost.

  • Early Bird: pay in full by December 2026 to receive a 5% discount on your total cost.

1.5 Payment methods and card fees. Payments can be made by credit card or bank transfer. Credit card processing fees apply and are payable by you. We do not store your card details.

1.6 Filling dates. The May experience will be filled first to make sure it is fully subscribed before other dates are opened.

 
2. Changes or Cancellations by Us

2.1 Minor changes. Because we plan a long way ahead, small changes sometimes happen (for example, a change of guide or a swap to accommodation of a similar or higher standard). We'll let you know as soon as we can, but these don't entitle you to compensation.

2.2 Significant changes or cancellation. Occasionally we may need to make a major change or cancel a departure — most commonly if the minimum of 30 participants isn't reached. If this happens, we'll tell you as soon as possible and offer you the choice of:

  • accepting the revised arrangements;

  • transferring to another available date or experience; or

  • a full refund of everything you've paid us.

2.3 On-the-day flexibility. Open water swimming depends on weather, water and safety conditions. Swim locations, timings or activities may change at short notice, and you're expected to follow the instructions of our guides and any local operators. Changes made for safety reasons are not grounds for a refund.

3. Changes or Cancellations by You

3.1 Changing your booking. If you want to change your booking, let us know in writing as soon as possible. We'll try to help, but changes depend on availability and may incur an administration fee of US$ 250 plus any difference in cost.

3.2 Cancelling your booking. If you need to cancel, tell us in writing straight away. The date we receive your written cancellation determines what (if anything) is refunded — see the table below.

3.3 Refund schedule.

Between 45 and 65 days before departure -        Partial refund — 50% of the balance, less deposit. 

Less than 45 days before departure -                   No refund

The $600 deposit is non-refundable at all times, regardless of when you cancel, this covers the upfront costs including merchandise, hotel cancellation fees and administration costs

3.4 Transferring your place. You may be able to pass your booking to someone else if you can't attend, provided you tell us in advance, they accept these terms, and any difference in cost or admin fee is covered. Because rooms are often shared, a transfer may not be possible if it would leave a rooming mismatch.

4. Your Responsibilities

4.1 Travel insurance (required). It is a condition of booking that you hold comprehensive travel insurance covering open water swimming, medical treatment, cancellation and repatriation. We may ask to see proof before departure.

4.2 Health and fitness. Each experience has fitness requirements. It's your responsibility to make sure you're fit to take part, and to tell us about any medical conditions or impairments at the time of booking (or as soon as they arise). This information is kept confidential and used only in an emergency. We may decline participation on safety grounds.

4.3 Travel documents. You're responsible for having valid passports, visas, entry permits and any required vaccinations. We can share general guidance, but we're not responsible for problems caused by missing or incorrect documents.

4.4 Behaviour. Please conduct yourself in a way that doesn't endanger or disrupt others. If your behaviour puts others at risk or causes serious disruption, we may end your participation without a refund, and you may be responsible for any damage you cause.

4.5 Arriving on time. Getting to the agreed start point on time is your responsibility. We're not responsible for missed connections or delays.

5. Our Responsibilities and Liability

5.1 We'll provide the arrangements described in your confirmation with reasonable skill and care, and choose our suppliers with reasonable care.

5.2 We're not liable for problems caused by your own actions, by third parties unconnected to our services, or by events beyond our control (see 6.1). Some activities are run by independent local operators under their own terms, and your contract for those is with them.

5.3 Except in cases of death or personal injury caused by our negligence, our liability is limited to the amount you paid for the experience. Nothing in these terms removes any rights you have under applicable consumer law.

6. General

6.1 Events beyond our control. We're not liable for changes or cancellations caused by events outside our control — for example extreme weather, unsafe water or marine conditions, natural disasters, pandemics or epidemics, civil unrest, terrorism, strikes, or transport failures.

6.2 Privacy. We handle your personal information (including health details you provide) in line with our Privacy Policy. By booking, you consent to this on behalf of everyone named on the booking.

6.3 Photos. We may take photos or video during the experience and use them for marketing. Let us know if you'd prefer not to be featured.

6.4 Complaints. If something's wrong during the experience, please tell us or your guide immediately so we can try to fix it. If it isn't resolved, write to us within 28 days of returning home and we'll respond promptly.

6.5 Governing law. These terms are governed by the laws of Victoria, Australia, and any disputes will be handled by the courts of that jurisdiction.

By paying your deposit, you confirm that you (and everyone named on your booking) have read, understood and accepted these terms and conditions.
