LiveThrive.ai ("we", "us", "our") runs the Swim4Seas experience. We respect your privacy and are committed to protecting your personal information. This policy explains what we collect, why we collect it, how we use and protect it, and the choices and rights you have.

We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). If you are located in the EU/UK, some additional rights may apply — see "Overseas participants" below.

2. The information we collect

Depending on how you interact with us, we may collect:

  • Identity details – name, date of birth, gender, and next-of-kin/emergency contact details.

  • Contact details – email, phone, postal address and social media handles.

  • Booking and payment details – the experience you booked, transaction records, and payment information (card payments are handled by our payment provider; we do not store full card numbers).

  • Health and dietary information – any medical conditions, allergies, dietary needs, and swimming/fitness information you give us. This is sensitive information under the Privacy Act and we only collect it with your consent, to keep you safe during the experience.

  • Travel documents – passport and visa details where needed for an international departure.

  • Website/technical data – IP address, browser type, device and usage information collected via cookies (see our Cookie Policy).

  • Marketing preferences – whether you'd like to hear from us and how.

If you don't provide information we need to run your booking safely (for example, essential medical or emergency-contact details), we may not be able to accept or complete your booking.

 

3. How we collect it

We collect information directly from you when you make an enquiry or booking, create an account, subscribe to updates, fill in a health or registration form, or contact us. We also collect some technical data automatically through our website, and occasionally receive information from third parties such as payment providers or analytics services.

 

4. Why we use your information

We use your personal information to:

  • process your booking and payments and manage your place on the experience;

  • share necessary details with the guides, accommodation providers, transport operators and other suppliers involved in your trip;

  • keep you safe — including passing relevant medical or emergency-contact information to guides or medical staff in an emergency;

  • communicate with you about your booking and send important updates;

  • respond to enquiries and handle complaints;

  • send you marketing about Swim4Seas and related experiences, where you've agreed to receive it;

  • meet our legal, tax and accounting obligations; and

  • improve our website and services.

We rely on your consent for sensitive (health) information and for marketing, on the performance of our contract with you to run your booking, and on our legitimate business interests and legal obligations for the rest.

 

5. Who we share it with

We share personal information only where needed, with:

  • the suppliers delivering your experience (guides, accommodation, transport, activity and medical providers), including overseas providers where your trip is international;

  • our payment processor and IT/service providers;

  • professional advisers (accountants, insurers, lawyers) where necessary;

  • government or regulatory bodies where the law requires it.

We require these parties to protect your information and use it only for the purpose we share it. We never sell your personal information.

 

6. Overseas participants and international transfers

Because our experiences may take place overseas, we may need to share your details with suppliers in the destination country to run your booking. Where we transfer information overseas, we take reasonable steps to ensure it is handled with appropriate protection.

If you are in the EU or UK, you also have rights under the GDPR (including access, correction, erasure, restriction, objection and data portability). Contact us to exercise any of these.

 

7. Keeping your information secure

We take reasonable steps to protect your information from loss, misuse and unauthorised access, and limit access to those who need it to do their job. If a data breach occurs that is likely to cause serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required.

 

8. How long we keep it

We keep your information only as long as needed for the purposes above and to meet legal, tax and accounting requirements (generally several years after your booking). When it's no longer needed, we securely delete or de-identify it.

 

9. Your rights and choices

You can ask us to:

  • give you access to the information we hold about you;

  • correct anything that's inaccurate or out of date;

  • stop sending you marketing (you can also unsubscribe via any marketing email); and

  • delete your information where we're not required to keep it.

To make a request, contact us using the details in Section 1. We'll usually respond within a reasonable time and won't charge a fee for routine requests.
